1. Agreement and contact

These Terms govern your use of afterfirstmca.com and its pages, calculators, and communications. By using the site, you agree to these Terms. If you do not agree, do not use the site.

2. Marketplace, not a lender

Afterfirst is a marketplace and shopping desk, not a bank, lender, or funder. Afterfirst does not make funding decisions. We may help organize information and, at your direction, send an application directly to the funders or lenders you choose. Funders and lenders decide whether to review a file, whether to make an offer, and every term, cost, payment, and eligibility requirement. We do not guarantee an offer, approval, amount, rate, cost, or funding date.

Applications and bank statements go directly to the merchant's selected funders or lenders. Afterfirst does not store application data or bank statements. Each recipient has its own agreement and privacy policy.

3. Your choices and our compensation

You decide whether to request an introduction, which funder or lender may receive your file, and whether to accept an offer. Before you sign, we disclose in writing who pays Afterfirst and how much, including whether a fee is added to an offer. We do not set a funder's terms.

4. Educational content and calculators

Articles, examples, tables, and calculators are educational tools provided as-is. They are not financial, legal, tax, accounting, credit, or investment advice, and they do not create a lender, broker, fiduciary, attorney-client, or other professional relationship. Calculator results are estimates; verify every number and read the actual offer and disclosure. Speak with qualified advisers about your circumstances.

5. Calls, texts, and email

Every call is recorded as company policy. Callers are told at the start and consent is obtained where required, including all-party consent where California law applies. Text conversations are recorded in the business communications record.

SMS is sent only with opt-in or within a person-initiated conversation. Marketing texts require express consent. Reply STOP to unsubscribe or HELP for help. Message and data rates may apply. Consent is not a condition of using the website or requesting information. We honor opt-outs promptly.

Quo (formerly OpenPhone) provides our phone and texting service. Its service may process recordings, transcripts, summaries, texts, and related data; an enabled Sona AI assistant may answer, take messages, summarize, or send a text within its configured workflow. We identify automated participation when it occurs.

6. Acceptable use

You may use the site for lawful business and informational purposes. You may not impersonate another person, submit a file without the merchant's permission, send altered or misleading documents, interfere with the site, probe its security, scrape it abusively, upload malware, infringe rights, use the site for unlawful discrimination, or send unsolicited or unlawful messages.

7. Intellectual property

The site, text, design, logos, software, and other materials belong to Afterfirst or its licensors. We grant you a limited, revocable, nonexclusive right to view the site for personal or internal business use. You may not copy, modify, sell, publish, or create derivative works from site materials without written permission, except for ordinary browser caching and brief quotations with attribution.

8. Third-party links and services

The site may link to regulators, funders, analytics providers, Quo, and other third parties. Links are provided for convenience. We do not control or endorse third-party sites, and their terms, privacy practices, offers, and security controls apply to your use of them.

9. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SITE AND ITS CONTENT ARE PROVIDED AS-IS AND AS AVAILABLE, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. AFTERFIRST DISCLAIMS WARRANTIES OF ACCURACY, COMPLETENESS, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AVAILABILITY, AND SECURITY. We do not promise that the site, a calculator, a communication channel, or a funder introduction will be uninterrupted, error-free, or suitable for your situation. Nothing in these Terms removes a right that applicable law does not allow us to limit.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AFTERFIRST AND ITS OWNERS, STAFF, SERVICE PROVIDERS, AND LICENSORS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITY, ARISING FROM OR RELATED TO THE SITE, A COMMUNICATION, A FUNDER OR LENDER, OR THESE TERMS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF AFTERFIRST FOR ALL CLAIMS RELATING TO THE SITE OR THESE TERMS WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID AFTERFIRST FOR THE RELEVANT SERVICE IN THE SIX MONTHS BEFORE THE EVENT OR ONE HUNDRED DOLLARS. These limits do not apply where prohibited by law.

11. Indemnity

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Afterfirst and its owners, staff, service providers, and licensors from claims, losses, liabilities, costs, and reasonable attorneys' fees arising from your breach of these Terms, unlawful use of the site, infringement of another person's rights, or submission of information without permission.

12. Governing law and venue

California law governs these Terms without regard to conflict-of-law rules. Any court proceeding relating to these Terms or the site must be brought in the state or federal courts located in Los Angeles County, California, and you consent to that venue and jurisdiction, subject to any non-waivable consumer law.

13. Changes and termination

We may change these Terms by posting an updated version with a new effective date. Your continued use after the updated date means you accept the changes. We may suspend or end access to the site at any time for security, legal, operational, or acceptable-use reasons. Provisions that by their nature should continue, including intellectual property, disclaimers, liability, indemnity, and governing law, will continue.

14. General terms

If a provision is unenforceable, it will be narrowed or severed to the minimum extent needed and the rest will remain effective. These Terms are the complete agreement about the site and replace prior site-use statements. No waiver is effective unless written. Headings are for convenience.
